I agree with Phil's analysis of color, exposure, scan, etc. I too have a hard time seeing this bird as a Phainopepla. The size alone compared to the Mullein should eliminate Phainopepla. Also on Mark Eton's provile picture, my moniter shows an orangish mandible, and the other picture seems to show a rather narrow, straight sided bill, which seems longer in this dorsal view than it does in profile. It may not be a Gray Flycatcher, but to me that looks closer than Phainpepla.
